By accessing and using Qgenie ("we", "our", "the Service"), you agree to be bound by these Terms of Use. If you do not agree, please discontinue use of the Service.

• Service: The Qgenie web application and related services used to generate and manage quizzes.
• User: Any individual or organization using the Service.
• Content: Any text, file, quiz, or data uploaded to or generated through the Service.
• Account: The user profile and credentials used to access the Service.

• You are responsible for providing accurate information and maintaining the confidentiality of your account credentials.
• You must be legally capable of entering into agreements where you reside. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

• You agree to use the Service only for lawful purposes and in accordance with applicable laws.
• You may not resell, sublicense, reverse engineer, decompile, or otherwise misuse the platform or its components.
• Violations may result in suspension or termination of your account, at our discretion.
• The Service may generate AI-powered content strictly based on your provided material; you are responsible for reviewing and validating generated content for accuracy and suitability.

• Qgenie offers free and paid subscription plans. Current plan limits include: Free plan up to 10 quizzes per month with 1–10 questions per quiz; Pro plan up to 500 quizzes per month with up to 100 questions per quiz. Limits may change and will be communicated on the website or dashboard.
• Payments are securely processed via third-party providers (e.g., Stripe). You authorize us to charge applicable fees for your chosen plan.
• Refunds may be requested within 14 days of purchase unless otherwise stated; eligibility may depend on usage. We reserve the right to approve or decline refund requests.

• From time to time, Qgenie may run promotions, giveaways, contests, or campaigns.
• Each promotion is governed by its own Official Rules or Additional Terms. If there is a conflict between these Terms and the Official Rules of a promotion, the Official Rules will control solely for that promotion.
• Eligibility requirements, prize details, entry periods, and tax responsibilities will be described in the relevant promotional materials.

• In the event of pricing, subscription, or content errors (including typographical or technical errors), Qgenie reserves the right to cancel, refuse, or correct any orders or subscriptions affected.
• If an incorrect price is listed or charged due to error, we may cancel the order or subscription and will refund any amounts paid.
• We may update information on the Service at any time without prior notice.

• All software, designs, logos, and trademarks remain the property of Qgenie and its licensors.
• Users retain ownership of their uploaded or input content, but grant Qgenie a limited, non-exclusive, worldwide, royalty-free license to process, store, and use such content solely to provide and improve the Service.

• If you submit ideas, feature requests, feedback, bug reports, or other suggestions (collectively, "Submissions"), you grant Qgenie a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Submissions into the Service without obligation to compensate you.
• You represent and warrant that you have all necessary rights to make the Submissions and that they do not infringe any third-party rights.
• Qgenie does not claim ownership of your original content; the above license is solely to operate, improve, and develop the Service.

• We respect your privacy and handle personal data according to our Privacy Policy. By using the Service, you consent to the collection and processing of data as described therein.
• Cookies and similar technologies may be used to improve the user experience, for analytics, and to remember preferences.

• Qgenie uses essential, preference, performance, and analytics cookies to operate the Service, remember settings, and understand usage.
• You can manage cookie preferences through your browser settings or applicable consent tools. Disabling certain cookies may affect functionality.
• For details, please review our Privacy Policy and any in-app cookie notices.

• Qgenie may integrate with external services (e.g., LMS platforms, cloud storage, and payment gateways). Your use of third-party services may be subject to their terms and privacy policies.
• We are not responsible for outages, failures, or issues caused by third-party providers.

• You may cancel your account at any time via the dashboard or by contacting support.
• Qgenie reserves the right to suspend or terminate accounts that violate these Terms, fail to pay applicable fees, or pose security risks, with or without notice.

• The Service may contain errors or interruptions and we do not guarantee uptime, availability, or that the Service will be uninterrupted or error-free.
• AI-generated outputs may be inaccurate or unsuitable. Qgenie does not provide professional advice and all content should be independently reviewed for accuracy and appropriateness.
• Any reliance on generated content is at your own risk.

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
• Qgenie shall not be liable for indirect, incidental, special, consequential, or punitive damages, including data loss, loss of profits, or service interruptions.

• You agree to indemnify, defend, and hold harmless Qgenie and its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
• (a) your access to or use of the Service;
• (b) your Content or Submissions, including alleged infringement of intellectual property or privacy rights;
• (c) your violation of these Terms or applicable laws;
• (d) misuse of data obtained through the Service; and
• (e) any disputes between you and a third party.

• Before filing any claim, you agree to attempt to resolve the dispute informally by contacting info@qgenie.ai. If we cannot resolve the dispute within 30 days, either party may pursue formal remedies.
• Where permitted by law, disputes between you and Qgenie will be resolved through binding individual arbitration administered by a recognized arbitration provider (e.g., AAA) under its applicable rules. You and Qgenie waive the right to a jury trial and to participate in class actions or class-wide arbitration.
• Small claims court and requests for injunctive or equitable relief may be brought without arbitration. You may opt out of arbitration within 30 days of accepting these Terms by emailing info@qgenie.ai with subject line: "Arbitration Opt-Out".

Qgenie may update these Terms from time to time. We will post the updated Terms on this page with an updated date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the jurisdiction in which Qgenie is established, without regard to conflict of laws principles. Where mandatory consumer protection laws apply, they shall prevail. The parties agree to resolve disputes through good-faith negotiation first; if not resolved, the matter will proceed to mediation and, where permitted by law, binding individual arbitration as described in the Dispute Resolution & Arbitration section. No specific court venue is designated in these Terms.

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: A failure to enforce any provision will not constitute a waiver of that or any other provision.
• Entire Agreement: These Terms, together with any Additional Terms or policies referenced herein, constitute the entire agreement between you and Qgenie regarding the Service.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Qgenie may assign these Terms as part of a merger, acquisition, or sale of assets.
• Force Majeure: Qgenie will not be liable for delays or failures due to events beyond our reasonable control.
• Headings: Headings are for convenience only and do not affect interpretation.
